Terms of Service

1. Agreement to Terms

By accessing or using Clear Desk ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Clear Desk ("Company," "we," "us," or "our").

2. Description of Service

Clear Desk is an AI-powered resume screening platform delivered as a Software as a Service (SaaS) web application. The Service enables users to:

• Create job postings with AI-generated descriptions
• Upload and process candidate resumes in PDF format
• Receive AI-powered screening results with match scores (0–100)
• View ranked candidate lists with detailed analysis
• Generate tailored interview questions for candidates
• Export results to CSV format

The Service is available in free and paid tiers, as described in Section 7.

3. Account Registration

To use Clear Desk, you must create an account. By registering, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to register. Only one account per individual is permitted.

4. Acceptable Use

You agree to use the Service only for legitimate recruitment and hiring purposes. You must NOT:

• Upload malicious files, viruses, or harmful code
• Attempt to hack, reverse-engineer, decompile, or probe the Service for vulnerabilities
• Use the Service for discriminatory hiring practices based on race, gender, age, religion, national origin, disability, or any other protected characteristic
• Exceed posted rate limits or programmatically abuse the Service
• Scrape, crawl, or automate access to the Service without written permission
• Use the Service to process data you are not authorized to access
• Impersonate another person or entity
• Use the Service for any unlawful purpose

5. AI Screening Disclaimer

• AI results are probabilistic estimates, not guaranteed assessments of candidate quality
• Human review is always recommended before making any hiring decision
• We are not responsible for hiring outcomes, missed candidates, or employment decisions made using our Service
• AI systems may contain inherent biases — users must verify results independently and ensure compliance with employment discrimination laws
• We make no warranty about the accuracy, completeness, or reliability of AI-generated scores and analysis
• Match scores are relative to the specific job description provided and may vary with different descriptions

6. User Content

• Ownership: You retain ownership of all content you upload, including job descriptions, resume data, and other materials
• Responsibility: You are solely responsible for the resume data you upload. You must have proper authorization to process candidate resumes
• License: By uploading content, you grant Clear Desk a limited, non-exclusive license to process your data solely for the purpose of providing the screening service
• Compliance: You must ensure that your use of candidate data complies with all applicable data protection laws and regulations

7. Free and Paid Plans

• Free Plan: 10 resume screenings per month, 1 active job posting. No credit card required
• Pro Plan: 500 resume screenings per month, unlimited job postings, advanced features. Priced at ₹1,999/month
• Enterprise Plan: Custom pricing for large teams with unlimited usage and premium support

Pricing is subject to change with 30 days' notice. Unused screenings do not roll over to the next billing period. No refunds are provided for partial months of paid plans.

8. Intellectual Property

• The Clear Desk brand, logo, website design, application code, and underlying technology are the exclusive property of Clear Desk
• AI-generated content (job descriptions, screening analysis, interview questions) is provided as a service output. You may freely use this generated content for your recruitment purposes
• You may not reproduce, distribute, or create derivative works from the Service without written permission

9. Limitation of Liability

• Our maximum aggregate liability to you shall not exceed the total fees paid by you in the 12 months preceding the claim
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We do not guarantee uninterrupted or error-free availability of the Service
• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied

10. Termination

• We may suspend or terminate your account for violations of these Terms, with or without notice
• You may delete your account at any time through the Settings page
• Upon termination, your data will be deleted within 30 days
• Sections regarding liability, intellectual property, and dispute resolution survive termination

11. Dispute Resolution

• These Terms are governed by the laws of India
• Any disputes shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India
• Before initiating legal proceedings, both parties agree to attempt good-faith negotiation for a period of 30 days

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the Service at least 15 days prior to taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
